2. General Terms and Conditions

The terms of sale apply to the rights and obligations arising between the customers of the Dermalogica.ee online store (hereinafter the Customer) and Kivilaine OÜ (hereinafter the Dermalogica.ee) when purchasing goods.
When registering as a user of Dermalogica.ee and / or purchasing products, the terms of this agreement and the rights and obligations arising from the legislation of the Republic of Estonia apply.
3. Entry into force of the contract of sale
Dermalogica.ee sells and the Customer buys the products offered in the e-shop.
The sales contract between Dermalogica.ee and the Customer enters into force upon receipt of the amount payable according to the order confirmation to the current account of Kivilaine OÜ.
4. prices
All prices in the Dermalogica.ee online store are in Euros and include 20% VAT.
Dermalogica.ee reserves the right to adjust prices. If the Customer submitted their order before the price changes took effect, then the price that was reflected on the invoice at the moment of placing the order applies to them. The customer has no right to demand compensation for the price difference.
5. Finalising the order and paying for the goods
When paying for the order, the Customer can choose the payment method that suits him / her – with a bank link or a credit card. The customer pays 100% of the order amount to confirm the order.
The sales contract is considered concluded and the execution of the order starts immediately after the Customer has paid 100% of the order confirmation.
You can pay in the Dermalogica.ee online store with the following payment methods:
Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay and Credit Card.
6. Delivery
After the sales contract enters into force (payment of the invoice by the Customer), Dermalogica.ee will complete the order and hand it over to our logistics partners for delivery.
The delivery terms shown on the Dermalogica.ee website are valid from the moment of payment of the invoice.
The Customer is obliged to notify Dermalogica.ee of any change in the destination or agreed time immediately before the delivery of the goods.
The avoidance of delays and misunderstandings in the delivery of goods depends on the accuracy and correctness of the information provided in the order. Dermalogica.ee is not responsible for delays in the delivery of products and misunderstandings if the delay or misunderstanding is due to the inaccuracy of the information provided by the Customer when placing the order.
Shipments that have been damaged during transport where the products, but not the product packaging, have been damaged will be replaced for the Customer. If replacement is impossible, we offer compensation for the cost of damaged goods.
7. Right of return
Pursuant to subsection 56 (1) of the Law of Obligations Act, the Customer may withdraw from the contract within 14 days after receiving the goods.
The returned goods must be unused, undamaged and in the original packaging.
The Customer must bear the cost of returning, unless the reason for returning is non-compliance with the order or defective goods.
In order to return the goods, a free-form return application must be submitted to the e-mail address info@dermalogica.ee within 14 days of receiving the goods. The return application must include the Customer’s name, product name and invoice or order number. You can also fill in the return application on this page.
The Customer will be reimbursed for the returned goods immediately, but not later than 14 days after receipt of the withdrawal application. In addition to the cost of the returned goods, the delivery costs of the goods will also be refunded.
8. Procedure for submitting claims
Pursuant to the Law of Obligations Act, the Customer is entitled to make claims against the seller in case any lack of conformity of a product becomes apparent within two years as of the date of delivery of the product. It is presumed that any defect that becomes apparent within the first six months existed at the moment of the sale and, therefore, the nature of the defect is to be identified by the seller.
In the event of a product defect, the Customer undertakes to notify Dermalogica.ee of the problem at the e-mail address info@dermalogica.ee and provide the following information: name, contact information and product defect. The respective application must be sent no later than within 2 months after the defect is discovered.
Dermalogica.ee is not responsible for:
  • For damage to the product caused by the customer’s fault or negligence
  • Defects caused by improper use of the product
  • For natural physical wear and tear of the product during normal use

 

9. Liability and force majeure

Dermalogica.ee is liable to the Client and the Client is liable to Dermalogica.ee for the damage caused to the other party by the violation of these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
Dermalogica.ee is not liable for damages caused to the Customer or for a delay in the delivery of the product if the damage or the delay in the delivery of the product is due to a circumstance that Dermalogica.ee could not have foreseen.
10. Privacy
By using the Dermalogica.ee website, the Customer gives clear and informed consent to Dermalogica.ee for the processing of their personal data.
Dermalogica.ee uses the information provided by the Customer only for the fulfillment of the Customer’s purchase order and does not disclose them to third parties.
11. Other conditions
Disagreements and disputes arising from the fulfillment of these conditions shall be settled by the parties primarily through negotiations. If disputes arising from the Agreement cannot be resolved through negotiations between the parties, the Customer has the right to apply to the Consumer Protection Board or the Court to protect their rights. Dermalogica.ee has the right to apply to the Court to protect its rights.
